JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 12-06-2017 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 457, 380 and 411 of the Indian Penal Code. As per prosecution case, on 16.11.2016 in the night theft was committed in the house of the informant by the petitioner and other accused persons.
It is submitted by the learned counsel for the petitioner that the petitioner was not apprehended at the spot and he has no concern with the offence rather his name has come in the confessional statement of co-accused Dewa Choudhary. It is further submitted that no incriminating article has been recovered from the physical possession of the petitioner. The petitioner is in custody since 24.01.2017.
Patna High Court Cr.Misc. No.26462 of 2017 (2) dt.12-06-2017 2/2 Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Sherghati, District- Gaya in connection with Lutua P.S.Case No. 14 of 2016.
