JUSTICE MIHIR KUMAR JHA ORAL JUDGMENT 05-05-2015 Learned counsel for the petitioner seeks permission to withdraw this application, wherein, following prayer has been made:- "For issuance of a writ of certiorari or any other appropriate writ, order or direction quashing order contained in Memo No. ZO/MUZ/MKV/IRD:12-13:777 dated 19.06.2012 issued under the signature of the Deputy Zonal Manager & Disciplinary Authority of the Respondent Bank, whereby and whereunder the Petitioner has been inflicted with major penalty of "Compulsory Retirement" from Bank's service in terms of regulation 4(h) of the Bank of India Officer Employees (Discipline & Appeal) Regulations 1976 with immediate effect.

For issuance of a writ of Certiorari or any other appropriate writ, order or direction quashing the order

Patna High Court CWJC No.20327 of 2013 (2) dt.05-05-2015 contained in Memo No. ZO/MUZ/IRD/13-14:0199 dated 28.05.2013 whereby and whereunder the Appeal preferred by the petitioner has been rejected and the penalty of "compulsory Retirement from Bank's Service" imposed upon the petitioner has been confirmed.

For issuance of a writ of mandamus or any other appropriate writ, order or direction, commanding the Respondent Authorities to reinstate the petitioner in Bank's Service with full honour and to pay him all consequential benefits, such as arrear of salary, increments etc. and further to treat him in continuous service."

That being so, this application is dismissed as withdrawn. It is however made clear that the petitioner now will have no liberty to move this Court again for the same cause of action and relief sought in this writ application.
