The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 302/201 of the Indian Penal Code.

As per prosecution, the sister of the informant is said to have been killed by some unknown persona and her dead body had been thrown at the Bamboo orchard.

Learned counsel for the petitioner submits that the petitioner is innocent and committed no offence. He has falsely been implicated in the present case. The petitioner is not named in FIR rather his name has been transpired in this case during course of investigation. The petitioner is languishing in judicial custody since 13.4.2022.

No. 45823 of 2021 (Annexure-1) but prior to allowing anticipatory bail application, petitioner has already surrendered before the court below on 13.04.2022 and the same fact was not disclosed by the learned counsel for the petitioner to the Hon'ble Court at the time of hearing Cr. Misc. No. 45823 of 2021 .

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Khagaria (Gangaur) P.S. Case No. 507 of 2016 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Khagaria.
