JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 21-06-2017 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner is regular seeking bail in connection with Nasriganj (Rajpur) P.S. Case No. 153 of 2016 registered for the offence punishable under section 395 of the Indian Penal Code and later on, section 412 of the Indian Penal Code has been added. The petitioner and other accused persons are said to have looted the Tempo of the informant and also snatched cash and mobile of the informant and his driver.
It is submitted by the learned counsel for the petitioner that the petitioner is quite innocent and has not committed any offence and has falsely been implicated in this case. It is further submitted that the petitioner is not named in the First Information Report, nothing has been recovered from the
Patna High Court Cr.Misc. No.19773 of 2017 (4) dt.21-06-2017 2/2 conscious possession of the petitioner, there is nothing in the case diary indicating the complicity of the petitioner in the aforesaid offence and he has been named in this case on the basis of confessional statement of co-accused, namely, Prem Chand Kumar Singh @ Prem Yadav, who has already been granted regular bail by a co-ordinate Bench of this Court in Cr. Misc. No. 10844 of 2017 on 18.05.2017.
Considering the facts aforesaid, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of 1st S.J.-cum-A.C.J.M., Bikramganj, Rohtas at Sasaram/Successor Court in connection with Nasriganj (Rajpur) P.S. Case No. 153 of 2016.
