The petitioner seeks bail in connection with Magadh University P.S. Case No.101 of 2016 registered under Sections 272 and 273/34 of the Indian Penal Code besides Sections 30(A) and 32(2) of the Bihar Amendment of Excise Prohibition Act, 2016.
The accusation is that in course of checking of the vehicles by the police, 1160 pouches, each containing 200 ml. country made liquor, 48 bottles, each containing 750 ml. Indian Made Foreign Liquor, and 71 bottles, each containing 375 ml. Indian Made Foreign Liquor, were recovered from the vehicle.

No.14375 of 2017 (6) dt.29-06-2017 2/2 Thereafter, one Pramod Bhokta, on chase, was apprehended by the police, who disclosed the name of the petitioner and Abhay Kumar alias Abhay Kumar Yadav, who succeeded to flee away. Learned counsel appearing on behalf of the petitioner submits that the petitioner was not apprehended on the spot by the police and the petitioner having no criminal antecedent is in custody since 08.02.2017. Further submission is that the similarly situated co-accused Abhay Kumar alias Abhay Kumar Yadav has already been granted bail by a Bench of this Court vide order dated 04.04.2017 passed in Criminal Misc. No.16422 of 2017. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-IX, Gaya, in connection with Magadh University P.S. Case No.101 of 2016.
