Learned counsel for the petitioner is permitted to remove the defect(s), as pointed out by the office, if any, within a period of three weeks from today.

The Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149 and 307 of the Indian Penal Code and 27 of the Arms Act. The petitioner and other co-accused persons armed with weapons came and co-accused Neeraj Kumar fired from pistol at the son of the informant with intention to kill causing injuries.

Learned counsel for the petitioner has submitted that

Patna High Court CR. MISC. No.71169 of 2021(2) dt.08-06-2022 2/2 the petitioner has falsely been implicated in this case. He has no criminal antecedent as stated at para 3 of the bail petition. The specific allegation of firing is against the co-accused persons, Neeraj Kumar. There is no overt act of the petitioner. Learned A.P.P. for the State has opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-XXIII, Patna in connection with Pirbahore P.S. Case No. 193 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
