JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 08-05-2019 At the outset, learned counsel for the petitioner submits that the petitioner has preferred statutory appeal being Appeal No. 55/2017 before the District Magistrate-cumCollector, Gaya which is pending for final consideration. The grievance of the petitioner is that despite filing of the appeal in the year 2017, till date no decision has been taken thereon.
Learned counsel for the State submits that in the given facts and circumstances of the case the writ application may be disposed of with a direction to the District Magistrate-cumCollector, Gaya to consider and dispose of the appeal within the
Patna High Court CWJC No.16597 of 2018(2) dt.08-05-2019 2/2 statutory period.
In similar circumstances this court has earlier expressed it's displeasure on the manner in which the statutory authorities are sitting over the matters which are required to be disposed of within a time fixed in the statute itself. This is one of those cases in which it appears that the District Magistratecum-Collector, Gaya has failed to dispose of the appeal within the statutory period.
By way of an indulgence this court directs him to dispose of the appeal within a period of 60 days from today after hearing the petitioner and by passing a reasoned order. In case of non-compliance of the order it will be open for the petitioner to move this court in an appropriate application. This writ application stands disposed of accordingly.
