JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 31-08-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in registered for the offences punishable under Sections 387, 354/34 of the Indian Penal Code and sections 3⁄4 of the Explosives Substance Act. As per the prosecution case, the petitioner and other accused persons made firing and threw bomb on the informant's house when he denied to pay ransom of Rs.50,000/- to him. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case due to quarrel of children of either sides. Petitioner is handicapped having clean antecedent.
Learned counsel for the State opposes the prayer for bail submitting that there is specific allegation against the
Patna High Court CR. MISC. No.71167 of 2021(3) dt.31-08-2022 2/2 petitioner that he and other accused persons threw bombs and two live bombs were also recovered from the place of occurrence.
Considering the specific allegation against the petitioner, his prayer for bail is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice. (Prabhat Kumar Singh, J) Shashi U T
