The petitioner seeks bail in connection with Warisliganj P.S. Case No. 178 of 2016, registered under Sections419, 420, 379, 467, 468, 471 and 120-B/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that while the petitioner is named in the F.I.R., but nothing has been recovered from his possession. Further submission is that the other co-accused Bipul Singh from whose possession ATM, PAN Cards and other material recovered has already been enlarged on bail by a co-ordinate Bench of this Court on 13.12.2016 passed in Criminal Miscellaneous No. 43004 of 2016. Further submission is that petitioner is in custody since

Patna High Court Cr.Misc. No.23581 of 2017 (4) dt.28-06-2017 2/2 15.02.2017 and after investigation, Police also submitted Chargesheet against the petitioner.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-II, Nawada in connection with Warisaliganj P.S. Case No. 178 of 2016. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
