The petitioner is a Company incorporated under the provisions of the Companies Act, 1956 situated at Barauni and engaged in the business of manufacturing of Hospital Gases. The Company entered into an agreement with the North Bihar Power Distribution Company for electric connection for a contract demand of 300 KVA and started taking power but, he failed to pay the electric charges and made a request for reduction of the load factor which was refused by the North Bihar Power Distribution

Patna High Court CWJC No.16481 of 2018(3) dt.16-03-2021 2/2 Company giving reason that within two years from the date of agreement, the prayer for reduction of load is not accepted. As the petitioner failed to make payment of the electric bill, the electric connection was disconnected.

Learned counsel for the petitioner submits that as on today, the total outstanding amount is Rs. 70,00,000/- approximately and he is ready to make payment of Rs. 8,00,000/- within a period of fifteen days from today.

If the payment of Rs. 8,00,000/- is made by the petitioner within the aforesaid period of fifteen days from today, the North Bihar Power Distribution Company will connect the power supply and the rest of the dues amount will be paid by the petitioner in 11 equal installments within a period of 11 months thereafter. The petitioner will also continue to make payment of the current charges. It is made clear that in failure to deposit any of the installments including the current charges, the North Bihar Power Distribution Company will be at liberty to disconnect the power supply of the petitioner company.
