This application for anticipatory bail arises out of Barauni P.S. Case N0. 65 of 2019, disclosing offences under Sections 287,304/34 of the Indian Penal Code. It is alleged in the First Information Report that the informant's wife came in contact with live 440 volt electric fence which was installed by the petitioner No.1 around a piece of land which petitioner No.1 had taken on patta, when she was moving on a pathway adjacent to a land Petitioner No.2 is son of petitioner No.1.

Denying the allegation that petitioner N0.1 had taken the said land on patta, learned counsel appearing on behalf of the petitioners has submitted that possibly in order to prvent damage of crops by blue bull, the land

Patna High Court CR. MISC. No.56961 of 2019(2) dt.09-09-2019 2/2 holder might have fenced the land with live electric wire. This FIR has been registered possibly to protect the landholder, he contends. He has submitted that the petitioners shall present themselves before the police and the Court for investigation, inquiry or trial as and when required.

Considering the submission so advanced, this application is allowed.

Let the petitioners above-named in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand)each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in Barauni P.S. Case No. 65 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
