The petitioner apprehends arrest in a case registered for the offence punishable under sections 379/307 and other ancillary sections of the Indian Penal Code.

Prosecution case is that while the informant was casting his roof it is alleged that all the accused persons used filthy language and assaulted all the family members of the informant. They also entered into the house of the informant and took away ornaments worth Rs. 5 lacs.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner and no specific overt act has been alleged against him.

Patna High Court CR. MISC. No.71090 of 2021(3) dt.31-08-2022 2/2 There is a case and counter case and the case filed by the petitioner side was earlier one. Injury caused by the petitioner was found to be simple in nature. Petitioner has got no criminal antecedent.

Learned counsel appearing for the State as well as the informant oppose the prayer for bail.

Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate III Danapur in Sigaudi Police Station Case No. 103 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
