Heard learned Counsel for the petitioners and learned APP for the State.

This application, for grant of anticipatory bail, arises out of Dumraon PS case no. 187 of 2024, disclosing offences punishable under Section 308 and other allied sections of the Indian Penal Code.

The prosecution story, as per the First Information Report, is that when the son of the informant was returning back with the milk, he was abused by the petitioners and other accused persons and when the informant went to the petitioners' home for knowing the reason behind abusing his son, petitioner no. 1 assaulted his wife by wooden plank and petitioner no. 2
Patna High Court CR. MISC. No.67129 of 2024(2) dt.22-10-2024 2/3 assaulted the informant by iron rod behind his head, due to which, they sustained injuries. It is alleged that co-accused persons assaulted other family members of the informant. 4.
Learned Counsel for the petitioners submits that both parties are neighbours and they were not on friendly terms due to some previous enmity. Injuries caused to the informant and his wife are simple in nature, as stated in paragraph no. 7 of this application. Learned counsel further submits that the occurrence has taken place on trivial issue between the son of the informant and other accused persons. The petitioners are stated to be having no criminal antecedent.

Regard being had to the submissions made on behalf of the parties and taking into consideration the fact that both parties are neighbours and according to the learned counsel for the petitioners, injuries caused to the informant and his wife are simple in nature and the petitioners are having no criminal antecedent, I am inclined to grant the privilege of anticipatory bail to the petitioners.

This application is, accordingly, allowed.

Let petitioners, abovenamed, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten

No.67129 of 2024(2) dt.22-10-2024 3/3 thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Dumraon PS case no. 187 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
