2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 126 ( 2 ), 115 ( 2 ), 109, 351 ( 2 ) and 3 (5) of the BNS. 3 . As per F.I.R., informant namely Mithun Paswan alleged that on 17.05.2025 , all the accused persons including these petitioners armed with knife , lathi and danda assaulted
Patna High Court CR. MISC. No.59253 of 2025(2) dt.01-09-2025 2/3 informant and his father due to which they sustained injury . It is further alleged that accused persons also threatened them with dire consequences.
4. It is submitted on behalf of the petitioners that both the parties are co-villagers. On account of previous dispute , an altercation took place between the parties. Allegation of assault is general and omnibus against these petitioners. Though there is allegation of assault against these petitioners but there is no injury report available on record. Petitioners claim clean antecedent.
5 . Learned counsel for the State oppose the bail petition .
6 Considering the general and omnibus allegation of assault against these petitioners, clean antecedent of these petitioners and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Bhabua Kaimur in connection with Bhabua P.S. Case No. 413 of 2025 , subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha
