2. Petitioner seeks regular bail in a case registered under Section 30(a) of the Bihar Prohibition and Excise Act.
3. As per prosecution case, there is recovery of 31.64 litres illicit liquor from co-accused Ram Kumar and on his instance, 360 ml. whisky was recovered from possession of the petitioner and he was arrested, thereupon on search, 2.7 litres whisky was also recovered from the house of petitioner.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Nothing has been recovered from conscious possession of the petitioner. The alleged recovery has been made from under construction house of co-accused Ram Kumar. Petitioner has no
Patna High Court CR. MISC. No.59345 of 2025(2) dt.11-09-2025 2/2 concern with the seized liquor of the place of recovery. Petitioner, who is a young boy aged about 21 years having no criminal antecedent, is in jail since 02.08.2025 and he undertakes to cooperate in the investigation and trial.
5. Learned A.P.P. has opposed the prayer for bail of the petitioner.
6. Having considered the facts and circumstances of the case as well as the submissions of the parties, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Exclusive Special Excise Judge, Saran at Chapra in connection with Gaura P.S. Case No.150 of 2025.
