JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-09-2019 This application, for grant of anticipatory bail, arises out of Pawana P.S. Case No. 30 of 2019, disclosing offences under Sections 341, 323, 308, 324, 379, 504, 506 and 34 of the Indian Penal Code.

Allegation as per F.I.R. is that petitioner no. 3 assaulted the informant on his head by means of rod, petitioner no. 2 assaulted him by means of Dabh and petitioner no. 1 is also named in the F.I.R.

Submission of learned counsel for the petitioners is that they have falsely been implicated in this case in the background of land dispute and a title suit bearing Titile Suite

Patna High Court CR. MISC. No.56632 of 2019(2) dt.06-09-2019 2/2 No. 387/2018 is pending between the parties and although there is allegation of assault, injuries sustained by the informant was found simple in nature.

Having heard both sides, in view of the above, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Ara, in connection with Pawana P.S.
