JUSTICE BIRENDRA KUMAR ORAL ORDER 04-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Section 414/34 of the Indian Penal Code, Sections 8/20/22 of the N.D.P.S. Act and Sections 137/147 of the Indian Railways Act.

The petitioner and other co-accused were apprehended on suspicion and from the possession of the petitioner a mobile phone and Andep tablets were recovered. Submission is that petitioner is in custody since 04.04.2017. Petitioner has stated on oath that he has got no criminal antecedent.

Considering the aforesaid fact, let petitioner,

Patna High Court Cr.Misc. No.28290 of 2017 (2) dt.04-07-2017 2/2 above named, be enlarged on bail on furnishing bail bond of Rs.20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cumSpecial Judge, Katihar/Successor Court, in connection with Katihar Rail P.S. Case No.37 of 2017, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
