The petitioner apprehends his arrest in a case registered for the offence under Sections 406, 409/34 of the Indian Penal Code.

As per the prosecution case, the petitioner, who was the then Block Education Officer, despite request did not submit Niyojan merit list as well as folder file of teachers for the session of 2006-2007.

It is submitted on behalf of petitioner that petitioner has already handed over charge of all the relevant documents to his successor and thereafter, joined his duty as Primary Teacher Training College at Mohania (Kaimur). It is further submitted that during investigation, the present B.E.O. has already reported to the concerned I.O. that petitioner has given charge of file in question, vide letter no. 297 dated 19.07.2021 (Annexure

Patna High Court CR. MISC. No.71206 of 2021(2) dt.20-07-2022 2/2 7). Petitioner claims clean antecedent.

Learned A.P.P. for the State has opposed the bail petition.

In view of letter no. 297 dated 19.07.2021, the prayer for anticipatory bail of petitioner is allowed. Let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - IV, Gaya in connection with Khijar Sarai P.S.
