JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-06-2017 The petitioner seeks regular bail in connection with Dulhin Bazar P.S. Case No. 49 of 2017, registered for offences punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.
Allegation against the petitioner is of recovery of 571 litres of foreign liquor.
It has been submitted on behalf of the petitioner that petitioner has not been arrested on spot and nothing has been recovered from his house or from his conscious possession rather the alleged recovery has been made from dalan, where other people also have access and, therefore, false implication of petitioner in this case cannot be ruled out. Petitioner has been in custody for last three months.

Having heard both sides, in view of the fact that in this case huge quantity of liquor has been recovered coupled with the fact that petitioner has criminal antecedent, I am not inclined to release the petitioner on bail, at least, at this stage. Petitioner's application for grant of regular bail is, accordingly, rejected. However, petitioner may renew his prayer for bail after framing of charge in this case.
