JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 04-09-2018 Though there are certain defects in the pleadings in disclosing the relief which the petitioners are seeking in the present writ application, it seems that their main grievance is against the decision of the National Council for Teacher Education (NCTE), which has been brought on record by way of Annexure-12 to this application, for issuance of the showcause notice to the petitioners-University as to why the application made by the University for recognition be not turned down, with reference to the reasons assigned therein.
Patna High Court CWJC No.16525 of 2018(2) dt.04-09-2018 2/2 Learned counsel for the petitioners has submitted that the petitioners have just downloaded the said part of the decision of the Committee and the University has not issued any show-cause notice as mentioned in Annexure-12. I am of the view that this is a premature application in the background of the averments made in the writ application and subsequent development which is indicated in Annexure-12 of the writ application.
It will be open to the petitioners to file appropriate reply, if such reply is sought for, from the competent authority. In such even the matter shall be decided, in accordance with law.
This application stands disposed of.
