The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Complaint Case no. 109 C2/2008 instituted for the offence under Sub Sections 26, 41 and 42-127 and 17 A, 27 and 32 of the Indian Forest and Wildlife Protection Act 1972. As per allegation in the FIR, it is a case of stone breaking of plot no. 1335 in illegal way by blasting by ten accused persons including the petitioner. By patrolling team, one tractor was seized and one tractor managed to ran away. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no

Patna High Court CR. MISC. No.71595 of 2021(3) dt.03-08-2022 2/2 offence. He has got no criminal antecedent. Petitioner has no concern with the seized tractor or with the alleged stone. Petitioner was not present at place of occurrence at the alleged date rather he was in his college.

Learned APP appearing for the State has opposed the prayer of Bail.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Complaint Case no. 109 C2/2008, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 2nd Lakhisarai subject to the conditions as laid down under section 438(2) of the Cr.P.C.
