====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 10-09-2025 Heard Mr. Randhir Kumar No.1, learned counsel appearing on behalf of the petitioner and Mr. Manoj Kumar Singh, learned counsel for the Union of India.
2. The petitioner seeks pre-arrest bail in connection with N.D.P.S. Case No. 13/2024 arising out of N.C.B. (Crime) Case No. 05/2024 registered for the offence punishable under Sections 8(c), 21(c), 27A and 29 of the NDPS Act.
3. Considering the nature of allegation made in the NCB Crime Case, as well as, the fact that the petitioner's name has surfaced in the present case on the basis of confessional statement of the co-accused namely Ravibhai Kediya who is alleged to have kept the prohibited medicine (cough syrup) in
Patna High Court CR. MISC. No.60836 of 2025(2) dt.10-09-2025 2/2 the train and the quantity of the seized prohibited medicine (cough syrup) was more than that of the permissible limit, I am not inclined to enlarge the petitioner on pre-arrest bail.
4. The petitioner, if so advised, may seek regular bail before the learned District Court. The learned District Court is directed to pass a necessary order, in accordance with law, on the basis of materials available on record, on the same day, the bail application is filed, without any further delay and without being prejudiced by any observation made by this Court.
