The petitioner seeks bail in Parsauni P.S. Case No. 94/2016, registered for the offences punishable under Sections 365, 366, 367 and 368 of the Indian Penal Code. The informant in her complaint petition alleged that while she was going along with Kanchan Kumari to a shop, the petitioner Ram Kishun Sah and his brother-in-law Kusheshwar Sah came and kidnapped her.
Learned counsel for the petitioner submits that during the course of investigation, it has come that father, mother and other family members of the informant were made accused in a case of murder and they were in custody. The informant developed
Patna High Court Cr.Misc. No.21086 of 2017 (3) dt.20-06-2017 love affairs with the petitioner. When the parents of the informant came out from the jail, they got this case lodged and thereafter again the victim fled away from the house and she was found in Delhi. During the course of investigation, the witnesses have stated that the victim developed relation with the petitioner and she also solemnized marriage. The police after investigation submitted charge-sheet under Sections 363, 366A and 498 of the Indian Penal Code.
Learned A.P.P. did not dispute this fact.
Considering the facts aforesaid and the fact that the petitioner is in jail since 30.11.2016, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate Ist Class, Sitamarhi in connection with Parsauni P.S. Case No. 94/2016. (Prabhat Kumar Jha, J.) Vinita/- U T
