JUSTICE ARUN KUMAR ORAL ORDER 15-06-2017 Heard learned counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Bidupur P.S. Case No.72 of 2017 registered under Section 30(K) of the Bihar Excise Act.
Allegation in brief is that the police reached at the bank of a river getting information that the liquor is being sold there seeing the police, people started fleeing away and petitioner was apprehended and two bottles each containing 75 ml Mahua liquor was found kept and disclosed names of other persons, engaged in selling the liquor.
Learned counsel appearing on behalf of the petitioner submits that the seized Mahua liquor is not recovered from conscious possession of the petitioner. The petitioner has been in
Patna High Court Cr.Misc. No.23980 of 2017 (2) dt.15-06-2017 2/2 custody since 4.3.2017 and has got no criminal antecedent. Having considered the said facts and circumstances, the petitioner, namely, Ghuntun Rai is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-XIV, Vaishali at Hazipur in connection with Bidupur P.S.
