The instant petition has been filed for grant of regular bail in connection with Bettiah Town PS case no. 723 of 2016 registered for the offences punishable under Sections 307, 379 and allied sections of Indian Penal Code. The case of the prosecution in brief is that on 28.12.2016 at about 12 in the afternoon while the informant was taking Deepak Kumar on his motorcycle to his residence after getting his X-ray done, four tyre vehicle hit the motorcycle of the informant. Thereafter, an altercation appears to have been taken place between the parties and petitioner is said to have beaten the

Learned counsel for the petitioner submits that petitioner has no criminal antecedent, he is in custody since 26.02.2017 and the matter has been settled and in support thereof, settlement deed dated 23.05.2017 has been filed before the registry of this Hon'ble Court, which has been placed on record. Having regard to the facts and circumstances of the case, I find it a fit case where the petitioner should be released on bail.

Accordingly, the abovenamed petitioner is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rs. Twenty thousand) with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate, Bettiah Town (West Champaran) in connection with Bettiah Town PS case no. 723 of 2016.
