The petitioner seeks bail in a case for the offence punishable under section 302/34 of the I.P.C Allegedly, in the occurrence the petitioner stabbed Bigau Singh to death and other co-accused have surrounded Bigau Singh.

Submission is of false implication and that the petitioner is in custody since 22.06.2015, no objectionable article like the knife or blood stained soil has been recovered from the place of occurrence, the other co-accused either has been granted regular bail or anticipatory bail, charge sheet has already been submitted and there is no chance of tampering with the

Patna High Court Cr.Misc. No.50558 of 2015 (2) dt.15-12-2015 2/2 prosecution evidence.

The learned A.P.P. opposes prayer for bail by submitting that the petitioner is the assailant. In the facts and circumstances as stated above, considering that the petitioner is the assailant and as such this Court is not inclined to enlarge the petitioner on bail and accordingly his such prayer stands rejected in connection with Bhabua (Sonhan) P.S. Case No. 249 of 2015 pending in the court of C.J.M. Bhabua.
