The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code.
According to the First Information Report, Khusabu Devi died in unnatural circumstances in her matrimonial house within three years of her marriage. There is allegation of demand of dowry and torture for the same soon before her death. Submission of the petitioner is that, in fact, Khusabu Devi had committed suicide due to some depression which would be evident from the suicide note.
The case diary reveals that the other witnesses have also supported the allegation of demand of dowry and torture for
Patna High Court Cr.Misc. No.49785 of 2016 (3) dt.27-01-2017 2/2 the same.
Considering the nature of allegation against the petitioner, I am not inclined to enlarge him on bail in connection with Kadirganj Police Station Case No. 27 of 2016 pending in the court of learned Judicial Magistrate-1st Class, Masaurhi, Patna/successor court.
Hence, prayer for bail is refused.
