This is a case registered under Section 414 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that the recovery of two stolen motor cycles are said to have been made from Darwaja of the house where he resides which is a joint family property of his father along with his two uncles. He further submits that the petitioner is an unsound mind person for which he has been treated in Darbhanga as also in Mumbai since January, 2014. He also submits that his father has inimical terms with Mukhia of the said village on account of previous Panchayat
Patna High Court Cr.Misc. No.28687 of 2017 (2) dt.01-07-2017 2/2 Election due to which has been falsely implicated in the instant case. The petitioner has no criminal antecedent prior to the instant case and he is in custody since 16.03.2017.
In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Biraul Darbhnga in Biraul P.S. Case No. 81 of 2017 G.R. No. 184 of 2017.
