This is an application for bail in connection with Bela P.S.Case No. 24 of 2017 registered for the offences punishable under Sections 8, 20(b)(ii)(B) of NDPS Act.

Allegation against the petitioner is of recovery of 2.6 kg. of ganja from his possession.

It has been submitted on behalf of the petitioner that petitioner has falsely been implicated in this case and he is in custody for six months having no criminal antecedent. Heard learned Central Government Counsel, who has opposed the prayer for bail stating that ganja recovered is not with the small quantity.

Having heard both sides and considering the aforesaid

Patna High Court Cr.Misc. No.25760 of 2017 (3) dt.12-07-2017 2/2 facts and circumstances, I am not inclined to grant bail to the petitioner.

However, learned trial court is directed to expedite the trial of the petitioner and try to conclude it within nine months. If trial is not concluded within the said period, petitioner may renew his prayer for bail.

With the above observation, this application is dismissed.
