====================================================== CORAM: HONOURABLE MR. JUSTICE RAJESH KUMAR VERMA ORAL ORDER 25-02-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 498(A), 364, 365/34 of the Indian Penal Code. Later on, Sections 304(B), 302 and 201 of the Indian Penal Code were added.

According to prosecution case, the petitioner married with informant's daughter, and thereafter, he along with other co-accused started torturing her for non-fulfillment of the demand of dowry. It is further alleged that the petitioner took the victim away. Later on, the victim girl was found dead. Learned counsel for the petitioner submits that the petitioner has clean antecedent and he has falsely been implicated in the present case. He further submits that the

Patna High Court CR. MISC. No.59135 of 2022(4) dt.25-02-2023 2/2 petitioner is husband of the deceased and the allegation as alleged in the F.I.R. is false and fabricated and there is no eyewitness of the alleged occurrence.

The learned Additional Public Prosecutor for the State has vehemently opposed the prayer for bail of the petitioner and submits that during investigation, it has come that the petitioner has committed the murder of his wife.

Considering the aforesaid facts, I am not inclined to enlarge the petitioner on bail in connection with S.Tr. No. 141/2022, arising out of Terhagachh P.S. Case No. 88/2021, pending in the court of learned Sessions Judge I/C, Kishanganj. Prayer is refused.
