JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-11-2019 This case has been listed today under the heading "To Be Mentioned" at the instance of the petitioners. It has been submitted by learned counsel for the petitioners is that vide order dated 08.11.2019, the prayer for anticipatory bail of the petitioner nos. 1 and 4 were rejected and petitioner nos. 2, 3 and 5 were allowed the privilege of anticipatory bail, however, there is no mentioning with regard to petitioner no. 5 in the said order.
Perused the order dated 08.11.2019 and also enquired
Patna High Court CR. MISC. No.58865 of 2019(4) dt.20-11-2019 2/2 from the diary maintained by the Court Master and it appears that learned counsel for the petitioners is right in his submission, as such, second last paragraph of order dated 08.11.2019 is modified to the extent that the same be read as under:- So far petitioner nos. 2, 3 and 5, above named, are concerned, in the event of arrest or surrender before the learned court below, they will be released on bail on furnishing bail bond of Rs. 25,000/- (Rs. Twenty Five Thousand) each with two sureties of like amount each to the satisfaction of the learned ACJM -XV, Gopalganj in connection with Kateya P.S. Case No. 227/2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
Let a copy of this order be communicated to the concerned court below forthwith.
