The petitioner seeks bail in Kotwali P.S. Case No. 287/2012, registered for the offences punishable under Section 304B of the Indian Penal Code.
The prayer for bail of the petitioner was earlier rejected vide order dated 21.12.2016 with a direction to the Trial Court to hold the trial on day to day basis and conclude the same within six months from the date of receipt/production of a copy of this order. The Senior Superintendent of Police, Gays was directed to ensure the attendance of all the prosecution witnesses. Learned counsel for the petitioner submits that in spite of direction of this court, the trial has not yet been concluded. Learned A.P.P. has submitted that nine witnesses
Patna High Court Cr.Misc. No.25265 of 2017 (4) dt.19-07-2017 2/2 have already been examined and only four witnesses are to be examined.
The Senior Superintendent of Police, Gaya who is present in the court has undertaken that she will produce all the witnesses within two months.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.
The trial court is directed to conclude the trial within two months from the date of receipt of this order. If the trial is not concluded within two months, the petitioner may renew prayer for his bail.
