This application is for grant of regular bail in connection with S.Tr.No.730 of 2016 arising out of Phulwari Sharif P.S.Case No.239 of 2016, registered for the offences punishable under Sections 498(A) and 307 of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act. The petitioner is husband and the case is of dowry death.
Submission of the learned counsel for the petitioner is that her statement has been recorded during the course of investigation which shows that the petitioner had taken her to the Hospital for treatment. The petitioner is in custody since 5.5.2016 Heard learned A.P.P. also, who has opposed the prayer for bail on the ground that the death is not in normal
Patna High Court Cr.Misc. No.25540 of 2017 (5) dt.07-09-2017 2/2 circumstances and further para 5 of the case diary shows that the petitioner had taken her Hospital for treatment but further it appears that he fled away from there.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner, as such the prayer for bail of the petitioner is rejected. However, learned Trial court is directed to expedite the trial and try to conclude it within a period of one year. With the aforesaid observation, this application is dismissed.
