The petitioner seeks bail in Patliputra P.S. Case No. 16 of 2021, registered for the offence punishable under Section 420 and other allied sections of the Indian Penal Code. As per the FIR, petitioner is alleged to have defalcated an amount of Rs. 40 lakhs of M/s Micky Anand Buildcon Pvt. Ltd. and informant is Director of the said company. From the case diary, it appears that several times the money has been transferred from the account of the Company to the joint account registered in the name of petitioner and his wife. However, petitioner undertakes that he will deposit the alleged amount referred in para 57 of the case diary of Rs. 11,70,000/- in twelve installment. However, such payment shall

In view of the undertaking given by this petitioner, the petitioner above-named, is directed to be enlarged on provisional bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate XII, Patna in connection with Patliputra P.S. Case No. 16 of 2021, subject to the condition that petitioner will deposit Rs. 1,00,000/- in the account of complainant within one week of his release and rest amount will be paid in five installment within one year. However, it is made clear that if the petitioner fails to fulfill the condition the court below shall cancel the bail application of the petitioner. After full payment, the provisional bail shall be confirmed by the court below.
