ANJANA MISHRA ORAL ORDER 03-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is in custody since 14.7.2014 in Dalsingsarai P.S. Case No.334/14 for the offence under Sections 302, 201, 34 of the I.P.C.

The allegation against the petitioner is that the informant had strongly suspected that the petitioner might have killed, the brother of the informant, as on previous day they had given some threat to the deceased.

Learned counsel for the petitioner submits that apart from the suspicion there is no other cogent material to support the prosecution story. It is further submitted that the deceased was found dead lying on the road and his two mobile were also found

Patna High Court Cr.Misc. No.45605 of 2014 (3) dt.03-03-2015 2/2 lying on the road which showed that his death might be result of any accident.

Considering the aforementioned submissions and that the petitioner has got no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., Samastipur, in Dalsingsarai P.S. Case No.334/14.
