ANJANA MISHRA ORAL ORDER 17-10-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 06.07.2019 in connection with Sultanganj P.S. Case No.149 of 2019 registered for the offence under Section 30(a) of the Bihar Excise and Prohibition Act, 2016.

Learned counsel for the petitioner submits that the recoveries are alleged to have been made from the house of the present petitioner, but it is in joint possession of the petitioner and others and the petitioner was not present at the time of recovery. The petitioner is not having any criminal antecedents.

Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on

Patna High Court CR. MISC. No.61943 of 2019(2) dt.17-10-2019 2/2 bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge Cum Special Judge (Excise Act), Bhagalpur, in connection with Sultanganj P.S. Case No.149 of 2019.
