Petitioner seeks bail in G.O. Case No.81 of 2017 for the offences punishable under Section 30(A) of the Bihar Excise (Amendment) Act.

Accusation is of recovery of 103 litres of illegal Nepali wine by the S.S.B.

It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in this case due to dirty village politics. Moreover, nothing has been recovered from his possession and he is in judicial custody since 28/02/2017. A statement has been made in paragraph no.3 of the petition that the

Learned APP for the State opposes the prayer for bail.

Considering the above facts and circumstances, this petition for bail is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional District and Sessions Judge-cum-Special Judge, Madhubani, in connection with G.O. Case No.81 of 2017.
