1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner has prayed for bail in a case registered for the offence punishable under Sections 457/380 of the Indian Penal Code.

3. As per the prosecution case, it is a case of theft of ornaments and other articles from the house of the informant by unknown persons.

4. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in this case and his name has transpired on the basis of confessional statement of co-accused Md. Chand Khan @ Sakir. The other co-accused Md. Asif has been granted bail by a coordinate bench of this Court vide order dated 26.07.2023 passed in Cr. Misc. No.

Patna High Court CR. MISC. No.64148 of 2023(2) dt.12-10-2023 2/2 44898 of 2023. Petitioner is in judicial custody since 08.05.2023.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.- I, Danapur, Patna in connection with Danapur P.S. Case No. 1146 of 2022.
