The petitioner has raised a grievance that neither he has been given the benefit of arrears of second ACP nor the benefit of third MACP. Though the calculation of 2nd ACP has been made but till date no payment has been made.

In such view of the matter, the concerned Authority is directed to consider the case of the petitioner and if he is entitled, in such circumstances, the payment of second and third MACP should be made to him. If the Authority finds that he is not

Patna High Court CWJC No.16335 of 2018 (2) dt.06-11-2018 2 /2 entitled, in such circumstances, the Authority will pass a reasoned order for refusal to grant of second ACP and third MACP. For convenience, the petitioner is directed to file a detailed representation before the concerned Authority, who will examine the case of the petitioner and pass a reasoned order in accordance with law within a period of eight weeks from the date of filing of the representation.

With the aforesaid observations and directions, this writ petition is disposed of.
