The petitioner is seeking regular bail in connection with Jehanabad P.S. Case No. 570 of 2016 for offence registered under Section 304(B) and 201/34 of Indian Penal Code.
Learned counsel for the petitioner submits that petitioner in the present case is father-in-law, who is in custody since 27.02.2017. He further submits that in the First Information Report there are allegations of demand of dowry and torture leading to the death of the daughter-in-law, however, there is no specific allegation against this petitioner. Patna High Court Cr.Misc. No.25604 of 2017 (2) dt.14-06-2017 2/2 submits that the husband of the deceased has already surrendered and is in custody since 23.01.2017. He further submits that Chargesheet has already been submitted and he is ready to cooperate in the trial.
Learned A.P.P. as well as learned counsel for the informant opposed the prayer for bail and submitted that it is a case of dowry death, however, Chargesheet has been submitted under Section 306 and 201/34 of the Indian Penal Code.
Considering the facts and circumstances of the case particularly that the petitioner is father-in-law of the deceased and husband is in jail and the investigation is over, let the petitioner Nandkishore Prasad @ Nandkishore Yadav be released on bail on furnishing bail bond of Rs. 10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad in connection with Jehanabad P.S. Case No. 570 of 2016, subject to the condition under Section 437 (3) Cr.P.C. and that the petitioner shall cooperate in the trial. In case of two regular defaults in appearance, the bail bond of the petitioner shall be cancelled by the Court below.
