JUSTICE RAJEEV RANJAN PRASAD ORAL JUDGMENT Date: 28-08-2018 It appears from the statement made in paragraph-11 of the counter affidavit that the victim girl in question has already been recovered on 20.01.2017. Nobody has appeared on behalf of the petitioner to press this writ application.

2. Taking note of the statements made in the counter affidavit particularly that the victim girl has already been recovered,

Patna High Court Cr. WJC No.1184 of 2016 dt.28-08-2018 2/2 this Court does not find any reason to keep the case pending before this Court. In case, the petitioner is of the view that the investigating officer in not concluding the investigation properly, he may file an appropriate application in the court below in the light of the judgment of the Hon'ble Supreme Court in case of Sakiri Vasu vs. State of Uttar Pradesh and others reported in 2008(2) SCC 409. If such an application is filed by the petitioner, the court below shall consider the same urgently keeping in mind the judgment of the Hon'ble Supreme Court.
