03. 13.07.2017 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in a case registered for offences under Sections 272 and 273 of the Indian Penal Code and Section 30(A) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 204 bottles of Nepali liquor each containing 300 ml and 11 bottles each containing 300 ml of country-made liquor were recovered from the possession of two persons including the petitioner carried it through bicycle. It is further contended that the co-

Patna High Court Cr.Misc. No.25194 of 2017 (3) dt.13-07-2017 accused person has already been granted bail by the court below. Petitioner claims that he is having clean antecedent and is in custody since 14.01.2017.

Having regard to the facts and the circumstances of the case, the petitioner, above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Jhanjharpur, Madhubani in connection with Laukaha P.S. Case No. 9 of 2017 (G.R. No. 65 of 2017) with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
