Patna High Court CWJC No.15972 of 2025 dt.24-04-2026 2/3 (Per: HONOURABLE THE CHIEF JUSTICE) Date : 24-04-2026 The petitioner Sudhir Kumar has approached this Court by filing this writ petition in the nature of Public Interest Litigation seeking for a direction to the respondent authorities to take immediate steps for removal of illegal encroachment from the Government land comprising the pond bearing Khata No. 1402, Khesra No. 1099 (Pokhar), Area- 25 decimals and Khesra No. 1100 (Bhinda), measuring an area of 36 decimals, situated at Village- Maheya, Panchayat Raj Malpur, P.O.- Malpur, P.S.- Patepur, Thana No. 557, Block and Anchal- Patepur, Anumandal- Mahua, District Vaishali, which has been illegally occupied by certain influential local individuals, including Respondent Nos. 9 to 12, who have constructed residential structures over the said land, causing serious obstruction and hardship to the local residents.

2. Considering the nature of the relief and the fact that the petitioner has an efficacious alternative remedy under the Bihar Public Land Encroachment Act, 1956, we do not find any merit to entertain the present application. However, the petitioner shall be at liberty to file an appropriate application before the authority concerned under the aforesaid Act for redressal of his grievance.

3. The writ petition stands disposed of with the liberty aforesaid.
