1. Heard learned counsel for the petitioners and learned APP for the State.

2. The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 341, 324, 307 and 34 of the Indian Penal Code.

3. The learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and petitioner no.2 is a senior citizen aged about 62 years and the informant alleges that on 01.02.2024 in the evening, when her husband was returning to his house when he was intercepted by the accused persons including the petitioners, who assaulted him with iron rod causing injury.

4. The learned counsel for the petitioners submits that from perusal of the allegation as alleged in the FIR, it would manifest that the allegation of assault is not specific and the

Patna High Court CR. MISC. No.64942 of 2024(2) dt.17-10-2024 2/2 entire family members have been implicated in the instant case on account of dispute relating to passage. It is also submitted that petitioners will not abscond rather will cooperate in the investigation to prove their innocence.

5. Learned A.P.P. opposes the anticipatory bail application.

Considering the submissions made by the learned counsel for the petitioners and the fact that there is no specific allegation of assault against the petitioners, as such, the petitioners, the petitioners, above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Arrah in connection with Koilwar P. S. Case No.54 of 2024, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

7. The application stands allowed.
