The petitioner apprehends his arrest in Bahera P.S. case No. 261 of 2019 registered under Section 30(a), 32(iii) & 41(a) of the Bihar Prohibition & Excise Act.

The informant got information that petitioner and his wife had brought whiskey (IMFL) for selling and on such raid was conducted. From the house of petitioner 100 bottles, each containing 375 ml, of Officers Choice whiskey were recovered. The learned counsel for the petitioner submits that seizure list was not prepared in accordance with law. The recovery is suspicious but it appears that 100 bottles, each containing 375ml whiskey, were recovered from the house of petitioner. Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
