NILU AGRAWAL ORAL ORDER 21-06-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner is languishing in custody since 14.04.2017 in connection with Murliganj P.S.Case No. 106 of 2017 for the offence alleged under Section 30 (a) of Bihar Prohibition and Excise Act, 2016.

The prosecution case as lodged by the police personnel is that during course of search from the house of the petitioner, 10 liters illegal Mahua wine was recovered from a room of the house of the petitioner and accordingly, seizure list was prepared.

No.26310 of 2017 (2) dt.21-06-2017 2/2 It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and has been falsely implicated in the aforesaid case, as he has no concern with the said Mahua liquor and he a labourer. It has been further submitted that nothing has been recovered from the conscious possession of the petitioner and he has no criminal antecedent. However, learned A.P.P. for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned I/C, Chief Judicial Magistrate, Madhepura in connection with Murliganj P. S. Case No. 106 of 2017.
