JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 03-11-2015 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case under Section 47(A) of the Excise Act.

Allegation against the petitioner is that 102 liters of Foreign Liquors was recovered from his house. The petitioner submits that his son-in-law is a licensee of Bihar State Beverage Corporation Limited whose shop is situated nearby. As his shop is under repair, the liquor has been kept in his house. Copy of the license has been annexed as Annexure-2 Series.

In the circumstances, in the event of arrest or surrender before the court below within four weeks from today the above named petitioner be released on bail on furnishing bail bond of Rs.5000/- (Five thousand) with two sureties of the like amount

Patna High Court Cr.Misc. No.48710 of 2015 (2) dt.03-11-2015 2 / 2 each to the satisfaction of Sri Manas Kumar, learned Judicial Magistrate, Bhagalpur in connection with Akbarnagar P.S. Case no. 79 of 2015 subject to the conditions as laid down under Section 438 (2) Cr.P.C.
