ANJANA MISHRA ORAL ORDER 26-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 04.07.2019 in connection with Bhaptiyahi P.S. Case No. 56 of 2019 registered for the offence under Sections 363 and 364 of the Indian Penal Code.

Learned counsel for the petitioner submits that though not named in the FIR, petitioner's name surfaced subsequently on the statement made by one Abhinav and he has been arrested on suspicion. It has further been submitted that the only statement made with regard to the petitioner is that the main accused person spoke to the petitioner. The petitioner has no role to play in the kidnapping. It has also been submitted that the petitioner is having no criminal antecedent.
