JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 03-03-2015 Petitioner is in custody since 3.7.2014 in relation to Mokama P.S.Case No. 120 of 2014, instituted under Section 302 and other sections of the Indian Penal Code.

The petitioner happens to be the younger brother of the deceased and Devar of the informant. She alleges that the petitioner had pushed her husband from the roof, as a consequence whereof he died.

Learned counsel for the petitioner points out that, in fact, the husband had fallen from the roof in a drunken state and died. Realising this fact the informant has filed a petition before the trial court. He also draws attention of the Court to these facts. This application for bail has been filed by the younger brother-in-law of the informant, who also would be the youngest brother of the deceased.

Be that as it may, in the facts and circumstances, let the
