JUSTICE MOHIT KUMAR SHAH ORAL ORDER 12-06-2017 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner seeks bail in connection with Khagaria P.S. case No. 122 of 2016, G.R. No. 386 of 2016, registered for the offence punishable under Sections 363, 365/34 of the Indian Penal Code.
It has been alleged that the petitioner and other accused persons had called the son of the informant namely, Neeraj Kumar aged about 17 years from his house, but he did not return. The learned counsel for the petitioner has submitted that merely on the basis of suspicion, the petitioner has been implicated in the instant case and he is in custody since 20.02.2016.
It has been further submitted that the investigation in
Patna High Court Cr.Misc. No.26562 of 2017 (2) dt.12-06-2017 2/2 the case is complete and charge sheet has been submitted, hence there is no need of the petitioner to be in custody any longer. It has further been submitted that similarly situated co-accused person, namely, Rikku has been directed to be enlarged on bail by order dated 23.02.2017 passed by a co-ordinate Bench of this Court in Cr. Misc. No. 3065 of 2017.
Having regard to the facts and circumstances of the present case as also the parity of the case of the petitioner to that of Rikku, I deem fit it appropriate to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 3rd, Khagaria in connection with Khagaria P.S. Case No. 122 of 2016, G.R. No. 386 of 2016.
